Children born in the Republic of Moldova will have the right to citizenship

Children born in the Republic of Moldova will have a guaranteed right to citizenship. The Parliament adopted amendments to the Citizenship Law, which excluded the provision according to which children born on the territory of the country can obtain the citizenship of the Republic of Moldova only if at the time of birth at least one of the parents has the right of residence, benefits from international protection or is recognized as stateless by the competent authorities.

The legislative initiative belongs to the deputy of the "Action and Solidarity Party", Angela Munteanu-Pojoga.

The draft law is supported by the People's Advocate Institution and the Equality Council, being mentioned as a legislative suggestion in the 2021 report on the situation of preventing discrimination in the Republic of Moldova.

The document aims to amend the Law on Citizenship of the Republic of Moldova in order to exclude the phrase that states that children born on the territory of the country can obtain the citizenship of the Republic of Moldova only if at the time of birth at least one of the parents has the right of residence, benefits from international protection or is recognized as stateless by the authorities competent.

By excluding this provision, the project seeks to comply with the legal norm with the provisions of the UN Convention on the Status of Stateless Persons, the UN Convention on the Reduction of Statelessness and the Convention on the Rights of the Child.

The legislative initiative that provides for the guaranteed right to the citizenship of the Republic of Moldova for every child born on the territory of our country was voted, in the second reading, by 68 deputies.
