Government approves new Urbanism and Construction Code
The Moldovan government has approved a new Urbanism and Construction Code (CUC), which will regulate all aspects of the sector, from land use planning to the authorization and execution of construction projects.
According to Minister of Infrastructure and Regional Development Andrei Spînu, the new code will help to reduce a number of common criminal offences, such as:
- Building on land without the right of ownership
- Modifying buildings in ways that endanger human life or the environment
- Preparing or signing construction plans by people who do not have the necessary qualifications
The new code also addresses a number of essential problems with the current legislation and will prevent the abusive interpretation of legal provisions. For example, the concept of tacit authorization, which has been the basis for a number of violations in the sector, will be abolished. In addition, the procedure for issuing urban planning certificates and construction permits will be simplified in the case of localities with a population of up to 3,000 inhabitants. This simplified procedure will benefit approximately 679 localities, with an estimated population of 1.5 million people.
The code also establishes the status, obligations, and responsibilities of professionals in the sector and creates a state register of companies in the field of urbanism and construction.
In addition, the code expands the list of construction works that can be carried out without an urban planning certificate for design and without a construction permit. In addition, the urban planning certificate and construction permit/demolition permit for objects declared to be of national public utility will be issued by the institution under the authority of the central specialised body.
