Case win for the Republic of Moldova at the Paris Court of Appeal

The Paris Court of Appeal annulled the sentence of the Paris ad hoc arbitral tribunal of October 25, 2013, in the case of SPC Stileks against the Republic of Moldova. The decision was taken on Tuesday, January 10, the Minister of Justice, Sergiu Litvinenco reports.

According to the official, the Court determined, in the absence of an investment protected by the 1994 Energy Charter Treaty, the arbitral tribunal lacks jurisdiction.

At the same time, according to the minister, in addition to ordering SPC Stileks to pay court costs, the appeals court also ordered the collection of €250,000 in favour of the Republic of Moldova as other costs.

Moldova 1 recalls that, by the judgement of the ad hoc arbitral tribunal (Paris, France) of October 25, 2013, the amount of 592,881,395 lei and 540,000 US dollars was ordered to be collected from the account of the Republic of Moldova for the benefit of LLC Energoalliance (currently SPC Stileks). The object of the case was the alleged non-payment by Î.S. "Moldtranselectro" of the electricity supplied during the years 1999-2000.
