Adviser to the governor of Gagauzia was released. Prosecutors cannot ask for arrest
Mihail Vlah, the advisor to the governor of UTA Gagauzia, Evghenia Guțul, was released after his 72-hour detention period expired. The prosecutors lack a legal basis to request preventive measures in this case, allowing Vlah to be investigated while in freedom. This information was confirmed by Emil Gaitur, the press officer for the Prosecutor's Office for Combating Organized Crime and Special Cases, in a statement to "Teleradio-Moldova."
"The sanction provided by the Criminal Code for instigation to violent actions, due to motives of prejudice, does not permit prosecutors to request arrest before judges", said Gaitur
Vlah is suspected of inciting violence after he posted a message on social media urging violent actions against President Maia Sandu and former President Igor Dodon. Following his message, officers from the National Investigative Inspectorate and prosecutors from PCCOCS conducted searches at Vlah's residence. He was detained on Saturday, November 9, for the maximum period of 72 hours.
Under the law, inciting violence through public statements is punishable by a fine of up to 52,500 lei, unpaid community service, or imprisonment of up to three years, depending on the severity of the act.
