Olesea Stamate about leaving the seat of member of Parliament

Olesea Stamate claims she is still unsure if she will resign from her position as a member of Parliament, as requested by the Action and Solidarity Party leadership yesterday after she was excluded from the party. Later, she said, she would make her decision public. The statements were made on the Punctul pe azi show on TVR Moldova.

"I have not yet left my position as a member of Parliament, and I am uncertain if I will. As I promised during my electoral campaign and in all my communications with citizens, I will continue to fight for justice and fairness. How I will do this will be revealed shortly," stated Stamate.

The former chairperson of the Parliamentary Committee on Legal Affairs, Appointments, and Immunities noted that the amendments to the amnesty legislation she proposed did not provide a lighter punishment for life-sentenced prisoners compared to what is established in the Criminal Code.

"When we approved this law, the Criminal Code stipulated that if a person served 30 years, they could be considered for release. The amnesty law mirrored this by commutating the sentence to 30 years. Therefore, they were identical. The amnesty law did not favor life prisoners in any way, and I want to clarify that. Subsequently, in 2024, the Criminal Law was amended through a project of the Ministry of Justice, reducing the 30-year term in Article 91 to 25 years. This was part of a broader project aimed at humanizing criminal policy," explained the Parliament deputy.

According to PAS, Olesea Stamate introduced three amendments to the Amnesty Law, which were voted on in 2021. These amendments allowed for the possibility of commuting life imprisonment to a 30-year sentence, enabling the application of Article 91, which allows for the conditional release of individuals who have served two-thirds of their sentence.

Initially, the Amnesty Law did not apply any sentence reductions to life prisoners. Yesterday, Parliament passed legislative amendments that will prevent life prisoners from benefiting from both commutation of their sentence under the amnesty and conditional release simultaneously.
