Court rules Gagauzia prosecutor law unconstitutional

The Constitutional Court of Moldova has ruled unconstitutional a provision that allowed Gagauzia’s People’s Assembly to nominate a candidate for the position of regional chief prosecutor.
The decision follows a constitutional complaint filed by Prosecutor General Ion Munteanu in late January. He argued that granting such a right to the regional legislative body contradicts Moldova’s Constitution, which affirms the unitary and indivisible nature of the state.
Until now, the regional chief prosecutor could only be appointed by the Prosecutor General following a nomination from Gagauzia’s People’s Assembly. Munteanu also argued that this procedure violated the principle of separation of powers.
The Court’s decision is final and binding.
