Moldova state to pay judge for illegal firing

The President of the Constitutional Court of the Republic of Moldova, Domnica Manole, could receive over one million lei from the state as back pay for the period 2017-2019, when, according to court decisions, she was illegally dismissed from her position as a Court of Appeal judge.
The request was partially accepted by members of the Superior Council of Magistracy (CSM) on Tuesday.
On March 24, Domnica Manole addressed the CSM requesting the reinstatement of her salary rights, specifically the payment of over one million lei. Over 600 thousand lei represents the salaries she did not receive during the period July 2017 - August 16, 2019, while the remaining amount, over 384 thousand lei, is the unique severance payment.
Livia Mitrofan, a CSM member, stated: "This request came as a result of the irrevocable decision of the Supreme Court of Justice (CSJ) on December 20, 2024, which reviewed the case following the European Court of Human Rights (ECHR) decision and annulled the dismissal of former judge Domnica Manole."
Furthermore, Manole requested the amount be indexed for inflation, asking for compensation worth 585 thousand lei.
"This request has been made to the CSM; it must be processed, and measures must be identified for allocating these funds," explained lawyer Angela Popil, "because as time passes, claims could potentially again be made that the Court's decision is not being executed."
CSM members rejected the request for awarding the 585 thousand lei in damages and only accepted the granting of the sum determined by the Court of Appeal. It should be recalled that, previously, the state was obliged to pay Domnica Manole 800 thousand lei in moral damages because she was subjected to an illegal investigation for three years.
