EU to ban destruction of unsold clothes and footwear by summer 2026

The European Union will strictly prohibit the destruction of unsold clothing and footwear starting in July 2026. Under the newly adopted Ecodesign for Sustainable Products Regulation (ESPR), major fashion retailers are banned from incinerating or discarding surplus inventory.

The mandate forces global brands to pivot toward circular business models. Companies must now prioritize discounted reselling, charitable donations, or high-grade material recycling to mitigate textile waste.

Implementation timelines

Large corporations must cease the destruction of unsold goods by July 2026. Recognizing the need for operational adjustments, small and medium-sized enterprises (SMEs) have been granted a transition period until 2030.

Furthermore, a mandatory transparency framework will debut in February 2027. Firms will be required to publicly disclose the volume of discarded products using a unified European reporting template.

Operational shifts and exceptions

Industry leaders are encouraged to integrate alternative solutions, including rental services, repair programs, and advanced recycling. This shift aims to dismantle the "fast fashion" logic of overproduction.

The European Commission will permit exceptions only under specific circumstances. These include verified safety risks or irreversible product contamination that renders the items unusable.

Market impact and environmental scale

For investors, stock utilization data will now serve as a key metric for business maturity. For global brands, EU market access is now intrinsically linked to circular economy principles.

Regulators estimate that 4% to 9% of unsold textiles in Europe are currently destroyed annually. This results in approximately 5.6 million tonnes of CO2 emissions, a footprint equivalent to the total net annual emissions of Sweden.

The new regulations seek to level the playing field for sustainable businesses. By eliminating the financial incentive for overproduction, Brussels aims to transform the textile industry into a high-accountability sector.
