Moldova defeats €24M arbitration claim by gas suppliers

Moldova won an international investment arbitration dispute after a Washington tribunal dismissed compensation claims exceeding €24.1 million (approx. 471 million MDL) filed by two natural gas suppliers, officials confirmed Wednesday.

The Washington-based International Centre for Settlement of Investment Disputes (ICSID) ruled that regulatory measures taken by Moldovan authorities during recent regional energy shocks did not breach foreign investor protections under the Energy Charter Treaty.

Tribunal dismisses damages and upholds regulatory fines

The arbitration was initiated in June 2022 by Liechtenstein-registered RTI Rotalin Gas Trading AG and its local subsidiary, Rotalin Gaz Trading SRL. The claimants alleged that retail tariff caps and market regulations introduced by Chisinau eroded their capital investments and disrupted market liberalization.

In its final ruling issued on October 2, 2026, the ICSID tribunal dismissed all damage claims against the Moldovan state with prejudice, ordering the companies to cover the full legal and administrative costs of the arbitration proceedings.

The tribunal also rejected Rotalin Gaz Trading's petition to annul a regulatory fine of approximately €1.97 million (approx. 38.45 million MDL) previously levied by the National Energy Regulatory Agency (ANRE).

Balancing investor protections with energy security

Moldova's Energy Ministry emphasized that the ruling establishes an important precedent for emerging economies managing emergency interventions while maintaining fidelity to international treaties.

“Moldova needs energy investments and transparent rules applied equitably,” said Energy Minister Dorin Junghietu in a press statement. “At the same time, authorities bear the fundamental duty to protect consumers and guarantee supply continuity during acute crises. The dismissal of these claims is a significant outcome for our country.”

Rotalin Gaz has operated in Moldova since 2003 under a national gas network expansion initiative, later securing retail distribution and supply licenses from ANRE in 2010. While the ICSID award is legally binding and definitive, parties retain narrow recourse to contest awards under strict annulment proceedings.
