The Constitutional Court rejected the complaint on the withdrawal of Ilan Șor's mandate as MP

The Constitutional Court rejected as inadmissible the application of the deputies of the "Șor" political party to review the constitutionality of the Parliament's decision to declare a deputy's mandate vacant. By the same decision, it was found that Ilan Șor's mandate as a Member of Parliament had ceased by right.

The complainants consider that Parliament adopted the contested decision without any legal basis. In response, in its decision to reject the complaint, the Court notes that one of the grounds for disqualification of a Member of Parliament is a prison sentence imposed by a final court judgment and the existence of an unresolved criminal record for offences committed with intent.

The Court was therefore unable to accept the applicants' arguments that the contested decision was adopted without a legal basis. The decision is final, is not subject to appeal, enters into force on the date of its adoption and is published in the Official Journal.

At the end of April, PAS deputies voted to lift Ilan Shor's mandate as a member of parliament. This decision was based on the decision of the Chisinau Court of Appeal, which sentenced Ilan Șor to 15 years' imprisonment in the bank fraud case.
